These Terms of Service ("Terms") govern your access to and use of the fitness community engagement analytics services provided by eatoutjkds d.o.o. ("eatoutjkds", "we", "our", or "us"). By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

User Obligations
As a user of eatoutjkds services, you agree to:
- Provide accurate and complete information when creating accounts or submitting data
- Use our services only for lawful purposes and in accordance with these Terms
- Maintain the security of your account credentials and notify us immediately of any unauthorised access
- Comply with all applicable laws and regulations in your use of our services
- Respect the rights and privacy of fitness centre members whose data is processed through our platform
- Not attempt to reverse engineer, modify, or interfere with our analytics systems
- Not use our services to transmit harmful, illegal, or inappropriate content
Account Registration and Access
To access certain features of our analytics platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in activities that may harm our services or other users.
Data Processing and Privacy
Our processing of personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection, use, and processing of data as described in our Privacy Policy.
You represent that you have obtained all necessary consents and permissions to provide member data to eatoutjkds for processing through our analytics platform, and that such processing complies with applicable data protection laws.
Intellectual Property
The eatoutjkds analytics platform, including its software, algorithms, user interfaces, and documentation, is protected by intellectual property laws and is the exclusive property of eatoutjkds or its licensors.
You are granted a limited, non-exclusive, non-transferable licence to use our services in accordance with these Terms. This licence does not grant you any rights to:
- Copy, modify, or create derivative works of our software or systems
- Reverse engineer or attempt to extract source code from our platform
- Remove or modify any proprietary notices or labels
- Use our trademarks, logos, or brand elements without written permission
Payment Terms
If you subscribe to paid services, you agree to pay all applicable fees as specified in your service agreement. Payments are due according to the billing schedule outlined in your subscription plan.
We reserve the right to suspend access to paid services for overdue accounts. Refunds, if any, will be provided in accordance with our refund policy as communicated at the time of purchase.
Service Availability
While we strive to maintain high availability of our analytics platform, we do not guarantee uninterrupted access to our services. We may temporarily suspend access for maintenance, updates, or to address technical issues.
We will provide reasonable notice of planned maintenance whenever possible, though emergency maintenance may be performed without advance notice.
Limitation of Liability
To the maximum extent permitted by law, eatoutjkds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.
Our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount paid by you for our services in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you to the extent prohibited by applicable law.
Indemnification
You agree to indemnify and hold harmless eatoutjkds, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
Governing Law
These Terms are governed by and construed in accordance with the laws of Slovenia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Ljubljana, Slovenia.
If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.
Termination
Either party may terminate the service agreement at any time with appropriate notice as specified in your subscription terms. eatoutjkds may immediately terminate or suspend your access to our services if you violate these Terms or engage in conduct that we deem harmful to our platform or other users.
Upon termination, your right to use our services will cease immediately. We may retain certain data as required by law or legitimate business purposes, as outlined in our Privacy Policy.
Changes to Terms
We may modify these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by posting updated Terms on our website and updating the "last updated" date.
Your continued use of our services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of our services.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced with valid provisions that most closely reflect the original intent.
